This Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your information when you use the DIVEROUT application and tells you about your privacy rights and how the law protects you. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

The words with capitalized initials have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Application refers to DIVEROUT, the mobile application and watchOS application provided by the Company for iOS, iPadOS, macOS, visionOS, and watchOS devices.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to DIVEROUT Tech Co., Ltd., registered in Taiwan.
  • Device means any device that can access the Service such as an iPhone, iPad, Mac, Apple Watch, or Apple Vision Pro.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.
  • Third-party Sign-In Service refers to authentication services such as Google Sign-In or Apple Sign-In through which a User can log in or create an account to use the Service.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, app interaction data, crash reports, and performance metrics).
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include:

  • Email address (for account registration and login)

Usage Data

Usage Data is collected automatically when using the Service. It may include information such as your device type, operating system version, app interaction data, crash reports, performance metrics, and other diagnostic data. This data is not linked to your identity and is used to improve the Service.

Health and Fitness Data

With your permission, our Service integrates with Apple HealthKit to read and write health-related data such as underwater depth, water temperature, and dive session information. This data is used solely to provide dive computer functionality and enhance your diving experience. Health data is stored locally on your device and in our secure cloud servers, and is never sold to third parties or used for advertising purposes.

Location Data

With your permission, our Service may collect precise location data to record dive site locations in your dive logs and to display nearby dive sites. Location data is used to enhance your dive logging experience and to enable features such as dive site mapping. This data is stored in our secure cloud servers along with your dive logs.

Photos and Videos

With your permission, our Service may access your photos and videos to enable AI-powered underwater color restoration and to attach media to your dive logs. Media processed through our AI color restoration feature may be temporarily uploaded to our servers for processing. Your original media files remain on your device.

Dive Log Data

Our Service collects and stores dive log data including dive profiles, depth, duration, water temperature, and other dive-related metrics. This data is synchronized to our cloud servers to enable cross-device access and backup. You may also import dive logs from other dive computer brands (such as Garmin, Suunto, and Shearwater) into our Service.

Third-Party Sign-In Services

You may create an account or log in to our Service using the following third-party authentication providers:

  • Google Sign-In: When you sign in with Google, we receive your email address and basic profile information from Google.
  • Apple Sign-In: When you sign in with Apple, we receive your email address (which may be a private relay email if you choose to hide your email) from Apple.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including monitoring the usage of our Service and synchronizing your dive logs across devices.
  • To manage your Account, to manage your registration as a user of the Service and provide access to different functionalities.
  • For the performance of a contract, the development, compliance, and undertaking of the purchase contract for products, items, or services you have purchased or of any other contract with us through the Service.
  • For analytics and improvement, to analyze usage patterns, diagnose technical issues, and improve our Service. We use services such as Sentry for error tracking and PostHog for analytics.
  • To contact you, by email or push notifications regarding updates, security alerts, or other information related to the Service.

Data Retention and Deletion

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

You may delete your account and all associated data at any time through the app settings. Upon account deletion, your personal data, dive logs, and any other data associated with your account will be permanently removed from our servers within 30 days.

Security of Your Personal Data

The security of your Personal Data is important to us. We use industry-standard encryption and security measures to protect your data. However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.

International Data Transfer

Your information, including Personal Data, may be transferred to and maintained on servers located outside of your country of residence. DIVEROUT Tech Co., Ltd. is registered in Taiwan and operates globally. By using our Service, you consent to the transfer of your information to Taiwan and other countries where we operate. We take appropriate measures to ensure that your data is treated securely and in accordance with this Privacy Policy.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
